Terms and conditions
How ordering and fulfilment work at Layerup Studio.

This is a translation for convenience. In case of any discrepancy, the Polish version of these terms prevails.

The seller
The services described here are provided by Andrii Hrymaliuk, trading as Layerup Studio, 05-091 Ząbki, Poland. The full correspondence address is provided on request, in particular for the purposes of a complaint.

The seller operates as unregistered business activity within the meaning of Article 5 of the Polish Entrepreneurs' Law. A proof of sale document is issued for every order.

Scope of services
Layerup Studio produces made-to-order FDM 3D prints: figurines based on photographs, NFC keyrings, cases, functional parts, and prints from files supplied by the customer.
Every order is prepared to the customer's own specification. The studio does not sell finished goods from stock.

Orders and formation of the contract
Orders are placed through the form on this site or through any contact channel listed in section 1. Sending the form is a request for a quote, not the conclusion of a contract.
Having received the request, the seller states the scope, the price and the delivery date. The contract is formed when the customer accepts that quote.
Before printing starts, the customer receives a preview of the 3D model or the layout for approval. Production begins only after written approval. Changes raised at this stage are made at no extra charge within the scope set out in the quote.

Prices and payment
Prices shown on the site are indicative and serve as a starting point for a quote. The binding price is the one given to the customer individually and accepted by them.
The price depends on size, material, print settings, quantity, the extent of post-processing and the deadline.
The seller is exempt from VAT. The amounts quoted are final amounts.
The payment method and due date are agreed individually when the quote is accepted.

Fulfilment and delivery
The delivery date is confirmed together with the quote and runs from the day the customer approves the design.
We ship within Poland. International shipping is possible once the cost has been agreed. Collection in person is also possible by arrangement.
The seller makes every effort to meet the agreed date. The customer is informed of any delay without undue delay, together with a new date.

Right of withdrawal
Under Article 38(1)(3) of the Polish Consumer Rights Act of 30 May 2014, the right to withdraw from a distance contract does not apply to non-prefabricated goods manufactured to the consumer's specification or serving their individualised needs.
Every Layerup Studio print is made for a specific order, so once the design has been approved and production has started, withdrawal is not possible.
This is precisely why the approval stage is mandatory: it is the point at which the customer can request changes or cancel the order at no cost.

Complaints
The seller is liable to consumers for the conformity of the goods with the contract on the terms set out in the Consumer Rights Act.
Complaints should be sent to layerupteam@gmail.com describing the defect and attaching photographs of the print received. The seller responds within 14 days of receipt.
An accepted complaint is settled by reprinting the item or, where that is not possible, by refunding the amount paid.
Characteristics inherent to FDM technology, of which the customer was informed before production, are not grounds for complaint: visible layer lines, support marks and dimensional tolerance of about ±0.3 mm.

Material supplied by the customer
By sending photographs, files or designs, the customer confirms that they hold the rights needed to use them for the order.
The seller refuses orders that would infringe copyright, trade mark rights or the personal rights of third parties, including their likeness.
Files and photographs supplied by the customer are used solely to fulfil that customer's order. Publishing a photograph of the finished work in a portfolio or on social media requires the customer's separate consent.

Product safety
Prints offered by Layerup Studio are decorative and functional objects intended for people over 14 years of age. They are not toys within the meaning of toy safety legislation and should not be given to children unsupervised.
FDM prints are not intended for direct contact with food. The layered structure traps contaminants that washing does not remove.

Final provisions
Matters not covered by these terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act.
The seller may amend these terms. Orders accepted before an amendment are fulfilled under the terms in force on the day they were accepted.
Consumers may use out-of-court complaint and redress procedures, including the European Commission's ODR platform at ec.europa.eu/consumers/odr.
